NOTIFICATION
NO. 25/05/2020-4IB-I DATED 29TH DECEMBER, 2020
In a
significant development for investors, MSMEs, and large industrial enterprises
operating in Haryana, the Governor of Haryana has ordered the continuation of
the Haryana Enterprises & Employment Policy-2020 (HEEP-2020) and all
schemes notified thereunder.
This extension
will remain effective until a new Industrial Policy is formally notified by the
State Government.
This decision
ensures continuity of incentives, subsidies, and industrial benefits, thereby
preventing policy uncertainty for ongoing and upcoming projects.
BACKGROUND
OF HEEP-2020
The Haryana
Enterprises & Employment Policy-2020 was introduced with the objective of:
Promoting industrial growth across the State
Encouraging investment in manufacturing and
service sectors
Generating employment opportunities for local
youth
Strengthening MSMEs and startups
Boosting exports and technology-driven
industries
The policy
consolidated various incentive schemes under one comprehensive industrial
framework and became the backbone of Haryana’s industrial promotion strategy.
WHAT DOES
THE EXTENSION MEAN?
The extension
implies that:
1. All
incentives and subsidies notified under HEEP-2020 continue to remain
operational.
2. Industries
can continue to apply for benefits under existing schemes.
3. Ongoing
projects will not face disruption due to policy lapse.
4. Legal and
financial planning based on HEEP-2020 remains valid.
In practical
terms, this ensures policy stability and investor confidence.
KEY
SCHEMES COVERED UNDER THE POLICY
The
continuation applies to schemes notified under HEEP-2020, including but not
limited to:
Capital Subsidy Schemes
Interest Subsidy Schemes
Employment Generation Subsidy
Stamp Duty Refund
SGST Reimbursement
Power Tariff Subsidy
MSME Support Schemes
Export Promotion Incentives
Industrial
units that have already applied or are planning to apply for benefits can
continue to rely on the existing framework.
IMPACT ON
MSMES AND LARGE INDUSTRIES
1. Relief
for MSMEs
For Micro,
Small and Medium Enterprises, especially those seeking subsidies or
reimbursement benefits, this extension avoids compliance uncertainty. Projects
sanctioned under HEEP-2020 remain protected.
2. Certainty for Large Investors
Large and mega
projects structured around fiscal incentives under HEEP-2020 can proceed
without renegotiation or restructuring.
3. Ongoing Applications
Applications
pending before District Industries Centres (DICs), HSIIDC, or other competent
authorities continue to be processed under the existing policy norms.
LEGAL AND ADVISORY PERSPECTIVE
From a
compliance and advisory standpoint, this extension:
Prevents litigation arising out of policy
discontinuation.
Protects legitimate expectations of investors.
Ensures continuity in subsidy claims and
disbursement.
Maintains enforceability of approvals already
granted.
Industries
should, however, ensure that:
Eligibility conditions are strictly complied
with.
Timelines for filing claims under individual
schemes are adhered to.
Documentation is maintained properly for audit
and verification purposes.
WHAT
SHOULD BUSINESSES DO NOW?
If you are
planning expansion or a new project in Haryana:
1. Review
eligibility under HEEP-2020.
2. File
applications within prescribed timelines.
3. Secure
provisional approvals wherever required.
4. Monitor
future notification of the new Industrial Policy.
This is a
strategic window for industries to secure benefits under a well-defined and
tested incentive regime.
CONCLUSION
The extension
of the Haryana Enterprises & Employment Policy-2020 through Notification
No. 25/05/2020-4IB-I provides much-needed stability and clarity to the
industrial ecosystem in Haryana.
Until the new
Industrial Policy is notified, businesses can continue to avail themselves of
the benefits and schemes under HEEP-2020 without disruption.
For industries
considering investment, expansion, or subsidy claims, timely compliance and
proper documentation remain crucial.
